These Terms & Conditions ("Terms") apply to your use of mobileatm.com and to ATM rental services provided by Stewart Ventures, Inc., doing business as MobileATM.com ("MobileATM," "we," "us"). By using the website or booking a rental, you agree to these Terms.

1. Website use

The website is provided for information and to request quotes. Pricing shown on the site, including estimates from the quote builder, is illustrative. A binding price is only established in a written quote or booking confirmation from us. We may change site content and published rates at any time.

2. Quotes and bookings

A booking is confirmed when we issue a written confirmation and any required deposit is received. Quotes are valid for 30 days unless stated otherwise. Rental rates are per machine per day; multi-day discounts, surcharge-free pricing, revenue-share arrangements, and delivery charges are as stated in your quote.

3. Customer responsibilities

You agree to provide accurate event details, a safe and accessible location for each machine, standard electrical power (or approved generator power) at the placement site, and reasonable protection from weather where required. You will not move, open, or tamper with any machine. You are responsible for damage to equipment caused by your staff, vendors, or guests beyond normal wear.

4. Our responsibilities

We will deliver, install, stock, monitor, service, and remove the machines as described in your booking. We will make reasonable efforts to keep machines operational throughout the event; brief outages due to connectivity, power, or hardware issues may occur and do not constitute a breach of these Terms.

5. Cancellation and changes

Cancellations more than 14 days before the event receive a full refund of any deposit. Cancellations within 14 days may forfeit the deposit. Date or quantity changes are subject to availability. If we must cancel for reasons within our control, we will refund all amounts paid; our liability is limited to that refund.

6. Payment

Rental fees are invoiced as stated in your booking. Surcharge-free transaction fees and any revenue-share amounts are reconciled and invoiced or paid after the event based on actual transaction records. Late payments may accrue interest at 1.5% per month or the maximum allowed by law.

7. Transaction fees and cash

Unless a surcharge-free option is selected, ATM users pay a per-transaction surcharge disclosed on screen. Cash in the machines remains our property. Any revenue-share payment is calculated solely from surcharge revenue as recorded by the machine's processor.

8. Limitation of liability

To the fullest extent permitted by law, MobileATM is not liable for indirect, incidental, or consequential damages, including lost sales or lost profits, arising from machine downtime or the services. Our total liability for any claim is limited to the rental fees paid for the event giving rise to the claim.

9. Communications

By providing your contact information, you agree that we may contact you by email or phone about your inquiry or booking. Text messages are sent only with your consent and are governed by our SMS Messaging Terms. Our handling of your information is described in our Privacy Policy.

10. Intellectual property

The MobileATM name, logo, and website content are owned by Stewart Ventures, Inc. and may not be used without written permission.

11. Governing law

These Terms are governed by the laws of the State of New York. Any dispute will be resolved in the state or federal courts located in New York.

12. Changes

We may update these Terms. The date at the top reflects the latest revision. Bookings are governed by the Terms in effect when the booking is confirmed.
